The Fair Housing Act
The federal Fair Housing Act (Title VIII of the Civil Rights Act of 1968, as amended) prohibits discrimination in the sale, rental, or financing of housing based on race, color, religion, sex, national origin, disability, and familial status. This law applies to all real estate transactions, including sales, rentals, advertising, mortgage lending, and homeowners insurance.
Under the Fair Housing Act, it is unlawful to:
- Refuse to sell, rent, or negotiate for housing based on a person's membership in a protected class.
- Make housing unavailable or deny that housing is available based on protected class status.
- Set different terms, conditions, or privileges for the sale or rental of a dwelling based on protected class status.
- Provide different housing services or facilities based on protected class status.
- Falsely deny that housing is available for inspection, sale, or rental based on protected class status.
- Engage in discriminatory advertising, including indicating a preference or limitation based on protected class status.
- Harass, coerce, intimidate, or interfere with any person exercising their fair housing rights.
- Fail to make reasonable accommodations or allow reasonable modifications for persons with disabilities.
Tennessee Fair Housing Law
The Tennessee Fair Housing Act similarly prohibits housing discrimination and is enforced by the Tennessee Human Rights Commission. It mirrors and, in some cases, expands upon the protections provided under federal law. We are committed to compliance with both federal and Tennessee state fair housing laws in every transaction we facilitate.
